Judgment :- When the matter was posted for final hearing on 31.1.2003, there was no representation for the appellant. But, the respondent's side was ready. Hence, the matter was posted today under the caption "for dismissal". Today also, there was no representation for the appellant. Therefore, the court has no option than to dismiss the second appeal for non prosecution. Accordingly, the second appeal is dismissed for non prosecution with costs.
