Judgment S.S.Nijjar, J. 1. We have heard the learned counsel for the petitioner and perused the paper-book. 2. A very serious charge was levelled against the petitioner which may be reproduced as follows;- "That you have sold 107 green trees which were standing on the shamlat land of Gram Panchayat without approval of the Deputy Commissioner and without evaluating from the Forest Department and in this way you have caused financial loss to the Gram Panchayat and have misused your office." 3. An enquiry was conducted. It was found that the defence taken by the petitioner that the trees have been cut by the electricity department was false. The plea has been taken merely to get out of the liability. The petitioner was unable to produce any evidence to prove that the trees have actually been cut by the Electricity Department. She was also unable to produce any document to show that the approval has been given by the Deputy Commissioner for cutting of the trees. The Deputy Commissioner, therefore, declared the Officer of Sarpanch vacant by order dated 14.3.2003. Against the aforesaid order, the petitioner filed an appeal before the Financial Commissioner which was also dismissed on 7.10.2003. Again after evaluating the entire record, the Financial Commissioner has come to the conclusion that the findings of fact recorded by the Deputy Commissioner are based on material. The Financial Commissioner has also come to the conclusion that the petitioner has not come to Court with clean hands. Therefore, on the basis of the ratio of law laid down by the Full Bench of this Court in the case of Charanji Lal v. Financial Commissioner Haryana, (1978)80 P.L.R. 582 (F.B.) it has been held that the petitioner that the petitioner is not entitled to any equitable relief. We find no infirmity in the orders passed by the Deputy Commissioner as well as by the Financial Commissioner. Sarpanch of a village holds a very responsible position. He or she has to be a role model for the whole village. The conduct of these dignitaries affects the young and impressionable minds of the growing young children in the village. In such circumstances, it is absolutely essential for the authorities to make sure that only individual with proven clean record and image continue to occupy such important offices. 4.

In view of the above, we find no merit in the writ petition and the same is hereby dismissed.
