ORDER 3.3.2003 — Heard Mr. M. K. Das, learned counsel for the petitioner and Mr. Nanda, the learned Addl. Govt. Advocate for the State. The case of the petitioner is that he is an unemployed Graduate and he applied for appointment as a P.D.S. retailer in Ward No. V in the vacant place of one Shri P. K. Sahoo, P.D.S. Dealer of Ward No. V. who has communicated his willingness to resign from retailership. Coming to learn this, the petitioner submitted an application to the Addl. District Magistrate. Cut¬tack for appointment as retailer under the Orissa P.D.S. (Con¬trol) Order, 2002 in Ward No. V of Cuttack Municipal Corporation. His case has also been recommended by the Inspector of Supplies for appointment as P.D.S. retailer in Ward No. V. vide Annexure-4 to the writ application. The petitioner had made repeated repre¬sentations to the Addl. District Magistrate and the Collector, Cuttack to consider his case for appointment as P.D.S. retailer for the aforesaid Ward No. V of Cuttack Municipal Corporation, but his applications/representations have not yet been considered by the authorities. We dispose of the writ petition with the direction that a certified copy of this order and copy of the writ petition with all its annexures will be filed by the petitioner before the Collector and District Magistrate, Cuttack (O.P.2) who will consider the case of the petitioner along with other applicants, if any, for appointment as P.D.S. retailer in Ward No. V of Cuttack Municipal Corporation in accordance with law and the guidelines if any, issued by the Government to that effect. The entire exercise will be completed and the orders so passed will be communicated to the petitioner within a period of two months from the date of receipt of the said copies from the petitioner.
