JUDGMENT Amitava Roy, J. 1. Heard Mr. B. K. Borah, learned counsel for the petitioner as well as learned State counsel for the respondents. As agreed upon by the learned counsel for the parties, I propose to dispose of this writ petition at the motion stage itself. The short facts are that the petitioner's father Late Milai Saikia was working as an Assistant Agricultural Inspector at the 'Fruit Preservation and Training Centre' in the office of the District Agricultural Office, Lakhimpur, North Lakhimpur and died in harness on 11.11.1999. The petitioner being his son filed an application thereafter for compassionate appointment in a Grade III/TV post in terms of the existing Government Policy. His grievance is that though he is eligible in terms of the policy to be considered for such appointment, the state respondents have not taken steps in that regard. He has referred to an office memorandum dated 9.9.1986 in this connection. Upon hearing the learned counsel for the parties and on a consideration of the materials on record, I dispose of this writ petition with a direction to the Respondent No. 2, the Director of Agriculture, Assam and the Respondent No. 3, the District Agricultural Officer, Lakhimpur, North Lakhimpur, Assam to take up for consideration the case of the petitioner and if he is found to be eligible in terms of the extant policy, executive instructions and guidelines they would, subject to availability of vacancy, pass appropriate orders redressing the grievance of the petitioner. The petitioner would submit a copy of this writ petition and its annexures including a. certified copy of this order before the aforementioned authorities and if the same is done the said authorities would complete the exercise directed hereinabove within a period of 2 months therefrom. No costs.
