JUDGMENT This is an appeal against the judgment and order dated 18.12.2002 passed by the District Forum, Udham Singh Nagar. 2. The brief facts of the case are that the complainant filed the complaint before the Forum that there was manufacturing defect in his Voltas Refrigerator. The appellant took the refrigerator for repairs but he did not return the refrigerator. According to the appellant the service engineer had taken only the compressor of the refrigerator along with him for checking & repairs if necessary. 3. The only question involved is whether the appellant has taken the complete Refrigerator or had taken only the compressor. There is oath against oath. The Learned Forum has believed the evidence of the complainant. We do not find any reason to interfere in that. But it may be true to some extent that the statement of the servant of the appellant could not have been disbelieved merely on the ground that he is a servant of the appellant but it is also true that there was nothing for the Forum for which the evidence of the complainant could have been disbelieved. There is only question of believing the evidence. We do not find any reason to interfere in the discretion applied by the Forum. There also does not appear any reason that a person will unnecessarily file the complaint without giving his Refrigerator to the appellant. It may be true that the dealer might have taken the Refrigerator and sent only the compressor to the appellant but here both the dealer and the manufacturer have denied that they have taken the refrigerator. At any rate the order passed by the Learned Forum is perfectly justified. We do not find any reason to interfere in this order. The appeal has got no force and is hereby dismissed. ORDER The appeal is hereby dismissed. Cost of the appeal shall be easy.
