JUDGMENT : I.A. No. 9 1. Heard and perused the contents of the affidavit dated 25.11.2002 filed on behalf of the High Court and other relevant papers. We are of the opinion that the issue arising for decision should not be treated as an adversarial litigation and the constraint of space which is being faced by the Courts should be a matter of concern for all the functionaries including High Court, the Central Government and the State Government. Smooth functioning of the Courts is essential to maintain law and order and consequently peace in the society - goal of any good governance. 2. It is directed that within a period of three weeks from today the representatives of the High Court, the Central Government and the State Government of Delhi shall meet and give their thoughtful consideration to the grievance raised and other associated and incidental matters and take a decision thereon considering the exigencies of the situation. We would await for the decision so taken for six weeks, failing which, this Court may be called upon to exercise its constitutional jurisdiction as available to it. We expect the issue to be dealt with at the minimum of Secretarial level so far as the Central Government and the State Government are concerned and thereafter, if necessary, at the ministerial level. 3.
