JUDGMENT L.C. Bhadoo, J. - Applicant by Shri Gurmeet Singh Ahluwalia, Advocate. State by Shri Prafull Bharat, Penal Lawyer Heard on M(Cr.)P No. 946/2003. 2. The accused/applicant is facing a case registered under Sections 307, 450, 323 and 148 of the I.P.C. at Police Station - Champa, District Janjgir Champa on the complaint of Firatram for causing injuries by means of a knife. 3. I have heard learned counsel for the parties. Learned counsel for the applicant argued that the main fatal blow of the knife was caused by co-accused Phooldas and the accused/applicant is a student and juvenile, he is appearing in the examination, and his examinations are to commence from tomorrow, therefore before considering this application for bail on merits, the applicant be released on therein bail at least for a period of 15 days so that he may take up the examinations for the Class-Xth. 4. I have perused the order of the trial Court. Having heard counsel for the parties and having regard to the facts and circumstances of the case, and having regard to the fact that the applicant is a juvenile and he has to appear in the examination of Class-Xth, I consider it to be a fit case for enlarging the applicant on bail for a period of 15 days. It is therefore, directed that the accused/applicant Kamal Das Mohant be released on interim bail for a period of 15 days from the date of his release on his furnishing a personal bond in a sum of Rs. 5,000/- with one surety in the like amount to the satisfaction of the C.J.M. concerned for his surrendering to the custody of the said Court immediately after completion of 15 days period. The counsel shall furnish papers with regard to the surrender of the accused/applicant to the custody. The matter be listed thereafter for hearing on merits. Certified copy as per Rules. Application allowed.
