JUDGMENT 1. - This appeal is directed against the judgment and award dated 16.2.1996 passed by the Motor Accident Claims Tribunal, Phalodi (for short, the Tribunal' hereinafter) whereby the Tribunal has awarded compensation of Rs. 53.000/- in favour of the appellant-claimants (for 5 short 'the claimants' hereinafter) who are the parents of deceased Mamta, minor girl who died in the accident." Deceased Mamta was travelling in Jeep bearing No. RJ 27/C 1700 in the night intervening 10th and 11th of March 1994 from Bap to Phalodi. While the said Jeep was plying along Kheerwa, a bus bearing No. RJ 13/- 0335 came from lo the opposite direction which was being driven at a great speed rashly and negligently by its driver and hit the jeep. Due to the accident Mamta received grievous injuries and succumbed to the injuries. The Tribunal held the driver of the bus negligent and awarded compensation against the owner, driver and insurer of the bus. The finding of the 15 Tribunal held the driver of the bus negligent and awarded compensation against the negligence of the driver of the bus and liability to pay compensation has not been challenged. 2. The only point argued by learned counsel for the appellants is that the Tribunal fell in error in awarding low compensation. 3. At the relevant time, the deceased, a minor girl, was student of 8th class. She was not an earning member of the family, however, on attaining majority, it may be presumed, she could have become an earning member of the family. The object of awarding compensation, however, is not only to make good the loss on financial aspect alone, it further seeks to compensate in terms of money for the tragic incident visited to a family. Considering all the facts and circumstances of the case, I am of the view that a sum of Rs. 80,000/- would be just and proper to be awarded by way of compensation in favour of the claimants. 4. No other point was raised. 5. Accordingly, this appeal is allowed. The compensation awarded by Tribunal is enhanced from Rs. 53,000/- to Rs. 80,000/-. The enhanced amount shall carry interest at the rate of 9 percent per annum from the date of application till realisation. No order as to costsAppeal Allowed. *******
