Judgment SHASHIKANT SHARMA, J. ( 1 ) HEARD learned counsel for the petitioner as well as learned Public Prosecutor appearing on behalf of State of Rajasthan. Persued the bail order passed by the learned Sessions Judge, Jhunjhunu and also perused the case diary and considered the relevant material placed before me for perusal. ( 2 ) ADVOCATE for the petitioner submits in this matter petitioner has been falsely implicated. He further submits that the statement of prosecutrix Suman under Section 164 Cr. P. C. has been recorded and even according to the statement of prosecutrix accused petitioner is innocent. He further submits that the age of the prosecutrix Suman is 18 years. He further submits that looking to the statement of prosecutrix. Suman, it is clear that petitioner has been falsely implicated in this case. These facts are not controverted by learned PP. ( 3 ) CONSIDERING all the facts and circumstances of the case, I deem it just and proper to enlarge the petitioner on bail under Section 439 Cr. P. C. ( 4 ) IN the result, the bail application of the petitioner Rajendra Singh is allowed and it is directed that he be released on bail in case arising out of FIR No. 37/2003 Pilani on furnishing a personal bond in the sum of Rs. 10,000/- (ten thousand) and two solvent sureties in the sum of Rs. 5,000/- each to the satisfaction of trial court for his appearance before that court on each and every date of hearing until conclusion of the trial. Application allowed.
