ORDER Karl Reddy, FC. - This is a petition under section 16 of the Punjab Land Revenue Act, 1887 seeking to revise the order dated 21.11.2001 of the District Collector, Ferozepore, appointing the respondent as Scheduled Caste lambardar of v. Dotarian Wali, tehsil Abohar, district Ferozepore, and the order dated of the Commissioner, Ferozepore Division, Ferozepore, upholding that order in appeal. 2. The District Collector vide order dated 10.8.2000 directed that proclamation be effected inviting applications up to 27.9.2000. The petitioner was the sole applicant. Thereafter an application of the respondent dated 19.6.2000 was unearthed. An application dated 14.7.2000 of one Bagu Ram was not considered. 3. It is patent that the respondent made a back door entry. Consequently, his appointment is set aside. The District Collector has mentioned that the petitioner is allegedly in illegal occupation of the Harijan dharamshala. The matter is remanded to the District Collector with the direction that he should arrive at a definite finding. If the petitioner is not in illegal occupation of the Harijan dharamshala, he shall be appointed. Otherwise, applications should be invited afresh. To be communicated. Petition allowed.
