JUDGMENT Heard the counsel for parties and perused the case dairy. This is first bail application u/s. 438 CrPC Crime No. 6/03 is registered against the applicant for committing offences u/s 436/34 IPC. It is alleged that applicant, alongwith his father Soma has put fire to the hut of the complainant and thereby caused damages to his property. Counsel for applicant submits that applicant is falsely implicated in the case as a civil suit between the parties is pending in the Court. Considering all the above facts, this application is allowed and it is directed that in the event of arrest, the applicant be released on bail on his furnishing a personal bond in the sum of Rs. 40,000/; with a solvent surety of like amount to the satisfaction of Arresting Authority. This order shall remain in force for a period of one month. In the meanwhile applicant can file an application for regular bail. If any adverse order is passed on the application, the same shall not be given effect to for a further period of ten days. C.C. as per rules.
