ORDER 1. The only question in this Letters Patent Appeal is whether the learned Judge has rightly declined in not treating the case of the petitioner similar to the case of Md. Badrujama Vs. The State of Bihar in CWJC No. 3785 of 1999. 2. Unfortunately the facts as emerged and noticed by the learned Judge in the writ petition are that the issue whether the petitioner could be considered in continuity of service at project school is not an aspect to be considered. The petitioner claimed that he was appointed as an Assistant Teacher at Ram Lagan Singh Madhkaul Balika Uchch Vidyalaya, Belsand. If the petitioner had continued then perhaps the petitioner could plea that his continuity be reckoned for whatever status he was entitled to. But the record reveals that the petitioner took leave by application between the period February 1990 to July 1992. The purpose of the leave was shown as "wife's illness". Later it was discovered that the petitioner was, in fact, working with a Primary School Chaklataya. In these circumstances the learned Judge has recorded that this aspect is virtually tantamounts to fraud and the petitioner had materially suppressed this fact. 3. In the circumstances the case of the petitioner cannot be similar to other cases where a pure academic question may arise as to what may be the status of teachers who were appointed at a project school. The appeal, in the facts and circumstances, is misconceived and is dismissed.
