JUDGMENT Shri Ajay Mishra, advocate states that the revision be disposed of only on the point of sentence as others are not pressed. Arguments heard. The facts of the case are that on 11.12.1985 sample of goat milk was taken from the applicant-accused by Food Inspector Suresh Kumar Khare. As per report of the Public Analyst Ex. P-12, it contained fat 3.2 percent and solids not fat 5.0 percent. As such it does not affirm with the standard and was termed as adulterated. The accused-applicant vide judgment dated 12.3.1993 in Criminal Case No. 620/89 passed by CJM, Panna was convicted under section 7/16 of PFA, Act and has been sentenced to undergo rigorous imprisonment for a period of six months and to pay fine of Rs. 1,000/- in default to suffer SI for a period of three months. A.S.J. Panna in Criminal Appeal No. 6/93 decided on 16.8.1995 modified the sentence and directed the applicant-accused to under go RI for a period of three months and to pay fine of Rs. 1,000/- in default to suffer SI, as ordered. At the time of passing of judgment in Criminal Case No. 620/89, the accused was aged about 55 years. At present the age of the accused must be about 72 years. In the facts and circumstances of the case as has been laid down in the judgment 1991 (II) MPWN 131 = 1993 MPLJ 345 , sending the accused-applicant to jail to serve the short term of sentence is not necessary. He remained in jai I for the period between 16.8.1995 to 30.8.1995 before he was released on bail vide order dated 30.8.1995 in Criminal Revision No. 635/95. Revision is allowed. Sentence awarded in Criminal Case No. 620/89 decided by CJM, Panna vide judgment dated 12.3.1993 and that in Criminal Appeal No. 26/93 vide order dated 16.8.1995 of ASJ Panna is modified to the extent that the applicant-accused to suffer the imprisonment for the period already undergone and pay fine of Rs. 1,000/-, in default to suffer SI for a period of one month. With the aforesaid, revision is deposed of.
