ORDER S.J. Mukhopadhaya, J. 1. This application was preferred by petitioner for issuance of a writ of mandamus or any other appropriate writ commanding upon the respondents to provide him option/selection of the discipline in Post-graduate of Medical Science, in accordance with merit list/rank secured in the Post Graduate Medical Admission Test. 2. According to petitioner, in pursuance of advertisement for admission in Post Graduate Medical Course, he applied and was provided with admit card with roll No. 510017 and appeared in the examination on 9th Feb. 2003. The result was published on 7th March, 2003 wherein the petitioner was shown to have secured 8th rank in the merit list and was asked to appear for counseling on 15th March, 2003 vide letter dated 8th March, 2003. The petitioner appeared for the counseling on 15th March, 2003 and submitted the residential certificate issued by the Circle Officer but it was not accepted having not issued by the competent authority. The petitioner immediately, thereafter, obtained a residential certificate from S.D.O. Ranchi on the same date i.e. 15th March, 2003 and again reported for his counseling on 15th March. 2003. 3. The grievance of the petitioner is that though the respondents, thereafter inclined to give him other discipline but did not agree to provide medical discipline, in accordance with petitioners choice and rank. 4. The respondents while accepted the aforesaid fact has taken plea that by the time the petitioner reported for the second time with residential certificate granted by S.D.O., there was no seat vacant as per petitioners choice. 5. The counsel for the State was directed to obtain instruction and state whether any seat is vacant because of non-joining of candidates in the faculty of General Surgery; Pediatric or General Medicine in any of the State Medical Colleges or not. In the supplementary affidavit, respondents have stated that 7 seat for general category are vacant in Rajendra Institute of Medical Sciences and 3 seats of general category are vacant in the M.G.M. College at Jamshedpur. 6.

In the facts and circumstances, taking into consideration the fact that the petitioner missed his first chance to give option on 15th March, 2003 and that a number of seats are still vacant for which the respondents may hold a second counseling to fill-up those seats, the respondents are directed to allow the petitioner to appear at the time of second counseling and to consider his case as per merit-cum-choice, in accordance with law. 7. The writ petition stands disposed of with aforesaid observation and direction.
