JUDGMENT It is the case of the petitioners that they were the students of Class-X examination, conducted by respondent/Board in March 2002 and inspite of the fact that they were permitted to appear in the examination and the results of the other candidates have been declared, the results of the petitioners have been withheld. Shri Shushil Chaturvedi, counsel for the respondents submits that initially the date for submitting the papers and mark-sheets of Class 8th and 9th was for last week of December, 2001 and for the school in question the time limit was extended upto 10.5.2002 and in all such cases where the mark-sheet and papers were not submitted by 10.5.2002, the results have been withheld. From the perusal of the documents which have been filed, it is clear that by annexure - p/8 dated 14.5.2002, the mark-sheets and papers in question of the petitioners were deposited by the School before the respondent/Board on 14.5.2002, even though the same should have been deposited by 10.5.2002, they have been deposited after a delay of four days. It is admitted fact that the petitioners have appeared in the examination and the School in question has committed approximately four days delay in submitting the papers. However, considering that the students were permitted to appear in the examination and now that their documents have been submitted, it is in the interest of their career that the respondent/Board should consider the totality of the facts and circumstances and take appropriate action for declaring the results of the petitioners in case they are otherwise eligible to be declared and mere four days delay should not come in the way of withholding the results of the students. Considering the aforesaid, it is directed that the respondent/Board shall examine the issue afresh and after verifying the fact with regard to deposit of the paper vide Ann. P-8 dated 14.5.2002 and further the genuineness of the documents, proceed to take a final decision in the matter and, if found eligible, declare the relief of the petitioners within a period of 15 days from the date of filing of certified copy of this order. The Board shall examine the issue afresh and shall pass order within the aforesaid period. With the aforesaid, petition is disposed of.
