JUDGMENT : 1. Heard the learned counsel for the parties. 2. Learned Additional Solicitor General appearing or behalf of the Union of India states that despite the affidavit dated 18th March, 2003, it would be open to the State of West Bengal to utilise the amount of Rs. 10 Crores which is lying with it for, the construction of 3rd and 4th module and proceed with the plant in accordance with the Project Report submitted by it in the month of January, 2003. He, further, states that necessary approval and financial sanction would be given within a period of fifteen days from today. 3. In view of the above, stand over to 29th July, 2003. I.A. No. 369 4. Liberty is given to the applicant to approach the High Court. Application stands disposed of accordingly.
