By Court.- The appellant was appointed as Assistant Teacher in a Primary School on 27th June, 1986 in Matric Trained Scale. 2. Earlier the promotion of assistant teacher in I.A./I.Sc. and B.A./B.Sc. trained scales were guided by different circulars and orders, which were subsequently repealed by the Bihar Take Over Elementary School Teachers Promotion Rules, 1993 which came into force with effect from 1st January, 1986. 3. It appears that by order dated 14.6.1995, the District Superintendent of Education granted I.Sc. and B.Sc. trained scale of pay to her respectively with effect from 1.4.1987 and 1.6.1987, which were cancelled by the District Education Establishment Committee on 4.9.1999. 4. Under Rule 5 of the 1993 Rules minimum eight years' teaching experience was required for such promotion. 5. The appellant challenged the order of the Establishment Committee cancelling her promotion orders aforesaid in C.W.J.C. no. 2971 of 1999 (R), which was dismissed by the learned Single Judge, by the impugned order dated 28.5.2001. The appellant has challenged the said order in the present appeal. 6. The appellant's entitlement of I.Sc. and B.Sc. trained scale was governed under the 1993 Rules and the orders of the District Superintendent of Education in the present case was rightly cancelled by the District Education Establishment Committee. The prayer of the appellant to decide as to from which date she would be entitled to the aforesaid scales is also within the jurisdiction of the Establishment Committee. 7. We, therefore, find no reason to interfere with the impugned order passed by the learned Single Judge. Accordingly, this appeal is dismissed with a direction to the committee to decide the dates from which the appellant is entitled to I.Sc. and B.Sc. trained scales of pay in accordance with law. 8. It goes without saying that the interim order dated 17.6.2002 passed by this Court along with disposal of the appeal automatically stood vacated.
