ARIJIT PASAYAT, SHIVARAJ V.PATIL

body2003
ORDER : Shivaraj V. Patil, J. - Pursuant to the issuance of the sale notice of the property in question [No.3, Aurangzeb Road, New Delhi], only one bid for a sum of Rupees twenty five crores and one lakh is received from the State of Israel, acting through its Embassy in India. In spite of the sufficient publicity and the passage of time, no other bid is received. Under the circumstances and having regard to the various factors, we think it just and appropriate to accept this bid. Accordingly, the bid given by the State of Israel, acting through its Embassy in India, is accepted. 2. The learned counsel representing the State of Israel submitted that because of the Bank employees being on strike, it may not be possible to deposit the demand draft as per the conditions of sale by tomorrow evening, i.e., 3rd May, 2003. Under the circumstances, he prays that some more time may be granted. To take care of this difficulty, we pass the following order: 3. The State of Israel, acting through its Embassay in India, shall deposit a cheque for the amount required to be deposited with the Registry of this Court by tomorrow, 3rd May, 2003. They can produce the demand draft for the said sum by Tuesday, i.e., 6th May, 2003. On producing the demand draft, it shall be open to the State of Israel to take back the cheque deposited with the Registry.
