Judgment 1. Heard the parties. 2. This writ application has been filed against the order dated 4/02/2000 passed by the Central Administrative Tribunal, Patna Bench, Patna, dismissing the application filed by the petitioner and upholding the order of removal from service as EDEPM, Jahagirpur Sham, P. S. Deshri, District Vaishali. 3. It appears that a proceeding was initiated against the petitioner on the complaint filed by one Pawan Kumar Patel. It was stated by him that his father had sent Rs. 800.00 vide Calcutta G.P.O. Insurance letter dated 11/05/1989 but the petitioner, who was EDEPM, Jahagirpur Sham, did not deliver the same and created forged document showing receipt of the money and later on after 38 days the money was delivered. A departmental proceeding was initiated after giving full opportunity and the petitioner was removed from service. The Tribunal upheld the order of the department as it did not find any legal infirmity in the order of removal. 4. Learned counsel appearing for the petitioner submitted that the order of punishment was passed mala fide as the complaint was filed by him against the Ex-EDEPM and he set up Pawan Kumar Patel to lodge false complaint against him. 5. Law is well settled that order of punishment if passed in a proceeding after giving full opportunity this Court cannot go into the merit of the case and has only to see whether in the decision making process the authority has committed some procedural irregularity in the sense that order was passed in violation of principles of natural justice or is based On no evidence or on irrelevant evidence or is perverse. 6. We have considered the materials on record and find that full opportunity was given to the petitioner and thereafter order of punishment has been passed which is based on evidence found during the enquiry. There is no legal infirmity in the order. 7. Accordingly, there is no merit in this application and the same is dismissed.
