JUDGMENT : 1. It is stated by the learned Amicus Curiae that the States of Chhattisgarh, Gujarat, Karnataka and Maharashtra have complied with the recommendations of the Shetty Commission as regards the pay scales to the Judicial Officers. Affidavits have already been filed by the States of Maharashtra and Chhattisgarh. Affidavits by the States of Gujarat and Karnataka be filed within two weeks. 2. In pursuance of our order, the Chief Secretary and the Advocate General for the State of Assam appeared before this Court. Learned Advocate General states that the Government has taken a decision to implement the pay scales as recommended by the Shetty Commission with effect from 1st April, 2003. So far as the arrears of salary are concerned, let an affidavit be filed within two weeks indicating therein the manner in which the arrears would be paid to the retired Judicial Officers as well as to those who are in service. 3. The Chief Secretary and the Advocate General for the State of Haryana appeared before this Court. Learned Advocate General states that the recommendations of the Shetty Commission have been implemented and an affidavit to that effect has been filed 4. The Chief Secretary and the Advocate General for the State of Himachal Pradesh appeared before this Court. Learned Advocate General states that within a period of two months the pay scales as recommended by the Shetty Commission shall be implemented. Let an affidavit to that effect may be filed within two weeks. 5. The Chief Secretary and the Advocate General for the State of Jharkhand appeared before this Court. Learned Advocate General states that a notification has been issued for implementation of the recommendations of the Shetty Commission as regards pay scales with effect from 1st July, 2002. So far as the arrears are concerned, let an affidavit be filed within two weeks indicating therein the manner in which the arrears of salary would be paid to the retired Judicial Officers as well as to those who are in service. 6. Learned Advocate General prays for and is allowed two weeks' time to file an affidavit indicating therein the date from which the recommendations as regards pay scales of the Shetty Commission shall be implemented. 7.

The matter relating to the States of Arunachal Pradesh, Nagaland, Meghalaya and Mizoram is deferred for the time being. 9. The Chief Secretary and the Advocate General for the State of Orissa appeared before this Court. Learned Advocate General prays for and is allowed four weeks' time to file an affidavit indicating therein the manner in which the pay scales as recommended by the Shetty Commission shall be implemented. I.A. No. 129 filed by the State is rejected. 10. The Chief Secretary and the Advocate General for the State of Uttranchal appeared before this Court. Ms. Rachna Srivastava, learned counsel appearing for the State states that the State Government has decided to implement the pay scales as recommended by the Shetty Commission and prays for and is allowed two weeks' time to file an affidavit to that effect. 11. The Chief Secretary and the Advocate General for the State of Punjab appeared before this Court. Learned Advocate General states that the State Government has taken a decision to implement the pay scales as recommended by the Shetty Commission. An affidavit to that effect be filed within two weeks. 12. The Chief Secretary and the Advocate General for the State of U.P. appeared before this Court. Learned Advocate General states that a decision has been taken to implement the pay scales as recommended by the Shetty Commission and an affidavit to that effect would be filed within 48 hours. 13. The Chief Secretary and the Advocate General for the State of Tripura appeared before this Court. Learned Advocate General states that the State Government has taken a decision to implement the pay scales as recommended by the Shetty Commission and three weeks' time may be granted to file an affidavit to that effect. Ordered as prayed for. 14. The Chief Secretary and the Advocate General for the State of West Bengal appeared before this Court. Learned Advocate General states that since there is legislative intervention and therefore two months' time may be granted to take decision in what manner the pay scales as recommended by the Shetty Commission are to be implemented. Let an affidavit to that effect be filed within four weeks. 15. Mr. M.N. Krishnamani, learned senior counsel appearing for the State of Rajasthan states that an affidavit has been filed indicating therein that the State Government has implemented the pay scales as recommended by the Shetty Commission. 16. Learned Attorney General appearing for the Union of India and the Union Territories states that the Central Government has made variation of pay scales of Judicial Officers in pursuance of recommendations by the Shetty Commission which is over and above the said recommendations except in some cases, but the same is not in that form. We are of the view that the pay scales as recommended by the Shetty Commission should be implemented in the letter and spirit and uniformly. He prays for and is allowed 10 weeks' time to file an affidavit indicating therein the date from which the recommendations will be implemented. 17. To come up after summer vacation on a date to be given by the Registry. 18. The Chief Secretaries and the Advocates General need not appear on any subsequent hearings unless they are required by the Court.
