JUDGMENT Heard. Applicant apprehends his arrest in Crime No. 4/2002 for having committed the offences under sections 302, 307, 147, 148 and 149 IPC and Ss. 25 and 27 of the Arms Act. Inviting attention to the report submitted under section 169 CrPC vide Annexure D-7 it is submitted by Shri Dwivedi, learned counsel for the applicant that cm report has exonerated the applicant. That apart, Surendra Singh is the main accused who is said to have inflicted fatal blow and the said accused has already been released on bail by this Court in Misc. Cri. Case No. 4129/02 vide Annexure D/10 dated 9.1.2003. Other two accused Rajesh Singh and Jitendra Singh have also been released on bail vide orders Annexures D/11 and D/12 respectively. Considering the totality of the circumstances and the material available on record at this stage, without expressing any opinion on the merits of the case, present application is allowed. On the event of his arrest, applicant shall be released on bail on his furnishing personal bond of Rs. 40,000/- with one solvent surety of like amount to the satisfaction of the arresting officer. This order shall be inforce for a period of one month. Applicant shall apply for regular bail before the competent Court. In the event of any adverse order having been passed against the applicant in the said application, the applicant shall not be arrested for a further period of fifteen days to enable him to move appropriate application for bail.
