JUDGMENT 1. - Having heard learned counsel for the appellant, we are of the opinion that no case for interference is made out. 2. On a representation made by the respondent-applicant, his pay was stepped up w.e.f. 10.7.1975 by order dated 21.3.1980 to make it at par with the pay of Shri Prem Shankar who was found to be junior to him but drawing salary higher than the respondent Modu Ram Kunkhuna. After about 20 years that stepping up has remained in force, pay of Shri Prem Shankar was revised and it was stepped down. 3. Consequently, the order of stepping down the pay of respondent No. 10 2, Modu Ram was also made. A recovery was also ordered for withdrawing the benefit of stepping up given to the respondent-applicant from the inception. The order dated 24.7.2001 to the aforesaid effect was challenged by said Modu Ram before the Central Administrative Tribunal through original Application No. 227/2003. 4. By the order under challenge dated 26.9.2002 while the Central Administrative Tribunal found that stepping down of the pay of Modu Ram vide order dated 24.7.2001 as consequence of stepping down Prem Shankar was justified, has not upheld the recovery of the amount from Modu Ram, as it would act to the great prejudice to the incumbent for no fault of his. 5. In the facts and circumstances of the case, we are of the opinion that there is no substantial failure of justice which could call for interference by this Court in its extra-ordinary jurisdiction. There is no misrepresentation or taking any undue advantage of any conduct of respondent-applicant in grant of additional pay by stepping up the pay. Under these circumstances, when the stepping up of the pay has remained in force for 20 years, there could be no justification for recovering the amount by reducing the salary retrospectively. We are of the opinion that the Tribunal was right in ordering that no recovery should be made before the date of stepping down. 6. We do not deem it proper to make any comments on merit of finding reached by the Tribunal about stepping down the salary. 7. The petition is accordingly dismissed in limine.Writ Petition Dismissed in Limine. *******
