JUDGMENT With the consent of parties, matter is heard finally. This petition is filed under section 482 CrPC challenging an order dated 23.4.2003 passed by 15th Additional Sessions Judge, Bhind in criminal revision No. 53/03 whereby Sessions Judge has confirmed the order dated 26.3.03 passed by Judicial Magistrate Class I, Mehgaon. Facts of the case are that brother of the applicant has lodged an FIR stating that the trolley owned by the applicant was stolen. The said trolley was registered as MP30 M/1634. The said trolley was seized by the police from accused persons. Thereafter, the present applicant has filed an application for handing over the said trolley on Supratnama under sections 451, 457 CrPC. The said application was rejected by order dated 26.3.03 as some other person Omprakash has raised an objection that he is the owner of the disputed trolley. Hence, both the Court below rejected the application for handing over the said trolley on Supratnama to the applicant and the said trolley is in custody of the police. Applicant is the registered owner of the said trolley. For this purpose he has filed a photocopy of the registration book issued by the RTO. Apex Court in the case of Sunderbhai Ambalal Desai v. State of Gujarat, 2003(II) MPWN 1 has held that the property seized by the police should be disposed of without any undue delay and the vehicle should be handed over to the registered owner. Present applicant is the registered owner of the said trolley. Considering this fact, I direct that the said trolley be handed over to the present applicant. Impugned orders passed by the two Courts below are set aside and this petition stands allowed. In view of the above order, M.Cr.P. 1058/03 stands disposed of.
