Judgment 1. The Court hardly understood why the present Letters Patent Appeal has been filed by the Bihar State Food and Civil Supplies Corporation Ltd. 2. Once the management came to a conclusion that two persons M/s Shiv Kumar Singh and Baleshwar Mishra had embezzled public funds and had indulged in black marketing by selling foodgrains which were otherwise meant for the Public Distribution System, and indeed if an inquiry had been instituted against both of them, then to treat one in dissimilar circumstances only shows that one employee was being favoured perhaps out of fear and for extraneous reasons. All that the learned Judge has said is that regard being had to the circumstances when the misdemeanour of the two employees was similar then the departmental proceeding brought against both must be treated as similar. 3. This Letters Patent Appeal by the Bihar State Food and Civil Supplies Corporation Ltd. is indeed frivolous, ill-advised and misconceived. 4. Dismissed.
