JUDGMENT 1. - This appeal arises out of the order of the learned Single Judge dated 12th December. 1995 in Civil Writ Petition No. 1138/85. By that order the learned Single Judge held that the respondent was entitled to promotion to Senior Scale of Rajasthan Administrative Service with effect from 12th February, 1979. The order of the learned Single Judge does not warrant any interference. 2. The respondent was denied promotion to the senior scale erroneously. His integrity certificate was with held by the State which led to his juniors to be promoted to senior scale with effect from 12th February, 1979. It is well settled that no person can be allowed to suffer for a wrong of another. The State withheld the integrity certificate for no fault of the respondent, even after the adverse entries in the service record for the years 1976-77 and 1977-78 were expunged by the Government. There was no justification for the State to withhold the integrity certificate for several years after the adverse remarks were expunged. In the circumstances, therefore, the learned Single Judge was right in directing the appellant to promote the respondent with effect from 12th February, 1979, the date from which 24 persons junior to the respondent were promoted to senior scale, with all consequential benefits of arrears of pay. It needs to be pointed out that while the writ petition was pending the State promoted the respondent to the senior scale but without giving consequential benefit of arrears of pay. The justification offered by the State for denying arrears of pay was based upon Rule 28(B), sub-rule (11-A) of the Rajasthan Administrative Service Rules, 1954. The appellant was not right in invoking the Rule for the purpose of denying relief granted by the learned Single Judge. The relief was the consequence flowing from a decision i of the Court. Even otherwise, the appellant w As not justified in refusing to grant senior scale from the retrospect' a date, when a large number of persons junior to the respondent were given the senior scale. 3. For the foregoing reasons, the appeal fails and is hereby dismissed.Appeal Dismissed. *******
