Judgment 1. Mr. Ram Chandra Prasad Bharti prays to delete relief no. 8. Let him do so in course of the day. 2. Prayer of the petitioner in this writ application is to grant him the benefits of the post of Deputy Law Adviser on which post he has worked since 3.4.1991 till the date of retirement on 31.1.2000. 3. In view of the order which I propose to pass in this writ application, it is inexpedient to give in detail facts of the case. Suffice it to say that a meeting of the Departmental Promotion Committee was held on 25.8.1990 for considering the cases of officers for giving Current charge of the post of Deputy Law Adviser. The Departmental Promotion Committee recommended the name of the petitioner for giving current charge of the post of the Deputy Law Adviser. It is the stand of the petitioner that in the light of the aforesaid decision of the Departmental Promotion Committee he started working as Deputy Law Adviser having current charge from 3.4.1991. Thereafter the Departmental Promotion Committee met on 18.7.1998 to consider promotion from the post of Law Officers to that of Deputy Law Adviser. The case of the petitioner was considered on the said date but it was resolved to keep his case pending with further direction to keep one post reserved. It is the stand of the petitioner that his case was kept pending on the ground of pendency of some vigilance enquiry. It is the assertion of the petitioner that by communication dated 18.9.1999 (Annexure-8) respondent Board was informed that no case or enquiry is pending, still the case of the petitioner was not considered and ultimately he retired from service on attaining the age of superannuation on 31.1.2000. Petitioner has further stated that he had filed representation dated 23.10.2000 13.6.2001, 15.3.2002 and 11.2.2003 for the redressal of his grievance but till date no decision has been taken. 4. Having heard Shri Bharti for the petitioner, Mr. Piyush for respondent nos. 1 to 8 and taking into consideration the facts and circumstances of the case I deem it expedient that the representation filed by the petitioner, if already not disposed of be disposed of within a period of four months from the date of receipt/production of a copy of this order. I direct accordingly. 5.
