JUDGMENT Heard this petition with consent finally. Having heard learned counsel for parties and having perused record of the case and in the light of the controversy sought to be raised by filing this writ petition, I am inclined to uphold the preliminary objections raised by the respondents as in my opinion it be a better course to direct the petitioner to file an appeal u/s 91 of the M.P. Panchayat Raj Adhiniyam before the Collector, for raising his all grievances. Even otherwise the nature of controversy demands that Collector who is the appellate Authority should examine as to whether proper procedure was followed by the Authorities concerned in selecting the candidate for Shiksha Karmi Grade III. While examining this issue, the collector (appellate Authority) will examine whether proper procedure for selecting the best candidate was followed by the selection committee, whether case of the petitioner was considered on its merits and whether selection made of a candidate was the best suited amongst those who appeared in the interview. This will be enquired into after examining the original record of the selection committee who interviewed the candidates and perused the records of the candidates in original. Let this be done within a period of six months from today. The petitioner is accordingly granted a month's time to file appeal before the concerned appellate Authority. On such appeal being filed, the same shall be decided in the light of the observations made supra. In case if any appeal is filed within a period of one month, the objection on the point of limitation shall not be allowed to be raised by the respondents. C.C. Within three days.
