Judgment 1. Heard counsel for the parties. 2. The petitioner seeks direction upon respondent no. 2 to grant him super selection grade scale with due date and thereafter pay the consequential benefits. 3. It is submitted by learned counsel for the petitioner that the case of the petitioner was recommended for consideration to grant him super selection grade scale, but till date no order has been passed upon the recommendation. It is further submitted that the petitioner also filed his representation in this regard after his superannuation, but the same is still pending consideration. 4. The plea of the State respondents in the counter affidavit is that for want of gradation list, the case of the petitioner and others could not be considered and preparation of gradation list at the Divisional level is in process. Counter affidavit was sworn on 31.1.2000 and what is the subsequent development, however, is not being focused before this Court. 5. In the given facts and circumstances of the case, in my opinion, it would not be appropriate for this Court to issue any positive direction to the respondents. However, the respondent authorities are directed to consider the representation so filed by the petitioner and pass necessary orders in accordance with law within a period of three months from the date of receipt/production of a copy of this order. 6. With the direction/observation aforesaid, this application is disposed of.
