JUDGMENT 1. - By way of instant petition under Section 482 Cr.PC. petitioner seeks to quash the order dated 24.11.2003 passed by the Additional Chief Judicial Magistrate, Anoopgarh, whereby he has taken cognizance against the petitioner for offence under Section 323 IPC. 2. The petition deserves to be allowed at the short ground. The alleged Incident took place on 27.6.1997. The police forwarded a negative report. The protest petition was filed on 15.7.2002. The cognizance has been taken on 241.11.2003. The limitation under Section 468 Cr.PC. is of three years for offence under Section 323 I.P.C. The incident is of 27.6.1997 as such cognizance could not have been taken after 26/27 June, 2000. 3. Consequently, the petition is avowed The order dated 24.11.2003 passed by the Additional Chief Judicial Magistrate, Anoopgarh, taking s cognizance against the petitioner is quashed and set aside.Petition Allowed - Cognizance Set Aside. *******
