Judgment 1. Heard counsel for the parties. 2. The petitioner seeks direction upon the respondents to appoint him on the post of Bigular Constable with all consequential benefits. 3. It is submitted by learned counsel for the petitioner that the petitioner was selected by the Selection Board for the post of constable in the year 1999 and appointment letter was issued to him. However, he was not appointed merely on the ground that he was overage. It is further submitted that at the time of his selection the petitioner was not overage and, accordingly, he was selected and at a subsequent stage, he is said to be overage by the authority. It is also contended that in a similar circumstance on Babuna Dubey and Shyam Balak Rai, who were also found to be overage, were appointed by the authority after giving due age relaxation vide order, as contained in annexure 8, and, therefore, the case of the petitioner could have been dealt with in the like manner it has been done in the case of Babuna Dubey and Shyam Balak Rai, as referred to above. 4. From the materials on record, it, appears that there is provision to relax the age in the Police Manual and also in the Bihar Service Code and this power has been exercised by the authority in case Babuna Dubey and Shyam Balak Rai. 5. The case of the petitioner, in this view of the matter, was required to be dealt with in the like manner, as it has been done in other cases by the authorities. 6. I am informed that the representation filed by the petitioner is still pending for consideration before the Director General of Police-cum-Inspector General of Police, Government of Bihar. 7. Considering the facts and circumstances of the case, the Director General of Police-cum-lnspector General of Police, Government of Bihar, Patna, respondent no. 2, is directed to consider the case of the petitioner and dispose of his representation in accordance with law in the manner it has been done vide order, as contained in annexure 8. This exercise, however, must be completed by respondent no. 2 within a period of three months from the date of receipt/production of a copy of this order. 8. With the direction/observation aforesaid, this application is, accordingly, disposed of.
