ORDER Petitioner alongwith others was engaged for Census work in the year 1991 were and after completion of census work they were retrenched. The census employees moved this court for direction to the State Government to consider their case for regularization. This court under order dt. 3.9.01 passed in CWJC No. 8750/2000 and CWJC No. 7329/01 directed the State respondents to take a final decision one way or the other in the matter of regularisation of 1991 census employees. In compliance of the aforesaid direction the State authorities have issued office order bearing no. 354 dt. 4.4.02 whereunder they have rejected their claim due to financial crunch as also there being complete ban imposed by the Government in the matter of employment on government post. 2. Learned counsel with reference to the instruction of the Chief Secretary bearing memo no. 6139 dt 23.8.04 which is taken on record of this case has submitted that the ban imposed on the class III/IV appointment In the State Government under Resolution bearing no. 8560 dt 30.12.86 ana 4675 dt 20.7.98 on account of resource crunch has since been withdrawn and according to the learned counsel State respondent should reconsider the matter in the light of the aforesaid instruction of the Chief Secretary dt. 23.8.04. He further submits that in the past census employees have always been absorbed and accordingly petitioner and other census employees of 1991 should also be absorbed in view of the past precedent. 3. As the 1991 census employees did commendable job and completed the census work within record time their case should again be considered sympathetically in light of the aforesaid instruction of the Chief Secretary of the State of Bihar bearing no. 6139 dt.23.8.04 within a period of three months from the date of receipt/production of a copy of this order. This application is disposed of. No cost.
