Judgment 1. Heard counsel for the parties. 2. The petitioner seeks direction upon the respondents to appoint him on the post of police constable pursuant to advertisement no. 1 of 1998. 3. It is submitted by learned counsel for the petitioner that the height of the petitioner was measured as 171 cm in the master chart, and, accordingly, call letter was given to the petitioner to appear for final test and in the final test his height was measured as 170 cm and since there was difference of one centimeter only he was not appointed on the post of police constable. It is further submitted that it would appear from annexure 8, the instruction issued by the Director General of Police, Government of Bihar, that in case, a person is found to be one centimeter shorter than his height recorded in the master chart then difference of one centimeter should be ignored, but the authorities without adhering to the guidelines issued by the Director General of Police, Government of Bihar, rejected the petitioner for his appointment on the post of police constable. 4. Learned counsel for the State submits that the petitioner may represent his case before the Director General of Police, Government of Bihar, Patna for redressal of his grievances. 5. It appears that admittedly, the petitioners height was found one centimeter shorter in the final physical test and that discrepancy would have been ignored by the authority in view of the guidelines, issued by the Director General of Police, Government of Bihar. 6. In view of the admitted facts, in my opinion, no useful purpose will be served by asking the petitioner to represent his case before the Director General of Police, Government of Bihar. 7. Considering the facts and circumstances of the case and for the reasons aforementioned, the authorities concerned are directed to consider the petitioner for his appointment on the post of police constable in light of the guidelines, issued by the Director General of Police, Government of Bihar, Patna, in case posts are yet to be filled up pursuant to advertisement no. 1 of 1998. This exercise, however, must be completed by the authorities within a period of three months from the date of receipt/production of a copy of this order. 8. With the direction/observation aforesaid, this applicafion is disposed of.
