JUDGMENT F.C. Bansal, J.— Heard learned counsel for the petitioner, learned Public Prosecutor and have also perused the case diary. 2. Learned counsel appearing for petitioner Amit Kumar submits that all the witnesses except police officials and formal witnesses, turned hostile and they did not support the prosecution before the trial Court and there is no direct evidence against the petitioner. As regards recovery of ‘Kulhadi’, blood was not found on it from serological examination by S.F.S.L., Rajasthan, Jaipur. It is further submitted that at the time of recovery of ‘Pant’ and ‘Shirt’ allegedly stained with blood, no independent witness was called by the I.O. and both the ‘Motbirs’ are police constables. It is also contended that despite orders passed by this Court twice, trial has not been concluded as yet and the petitioner is in custody since 19-8-2003. Therefore, this second application for bail be allowed. 3. Learned Public Prosecutor appearing for the State has opposed the bail application. 4. Considering the aforesaid sub-missions and after having gone through the statements of the witnesses recorded by the trial Court as also the other evidence collected during investigation, I am inclined to allow this second application for bail filed under Section 439 Cr.P.C. 5. It is, therefore, ordered that petitioner Amit Kumar S/o Late Shri Sushil Kumar be released on bail provided he furnishes a personal bond in the sum of Rs. 10,000/- (Rs. ten thousand only) with two sound sureties of Rs. 5,000/- (Rs. five thousand only) each to the satisfaction of the trial Court with the stipulation to appear in the Court as and when called upon to do so during pendency of the trial against him in the case arising out of F.I.R. No. 202/2003, P.S. Chirawa, District Jhunjhunu. Petition allowed.
