JUDGMENT : After having heard the counsel for some time, we are of the view that it is appropriate to decide the main writ petition instead of passing piecemeal orders on the I.As., especially for the reason that the contentions overlap to some extent. The writ petition together with the I.As. may be posted before the appropriate Bench as per the orders of Hon'ble Chief Justice, preferably after Diwali vacation. Mr. Rajiv Dhawan, learned amicus curiae and Mr. Pradeep Aggarwal, learned amicus, have expressed their desire to be reclused from the case in view of the possible conflict of interest arising out of the appearance of Mr. Rajiv Dhawan in Suit No. 6/96. Their request is granted. Mr. S Muralidhar is nominated as amicus to assist the Court. On request, a set of papers may be furnished to him by the Registry. 2. It is brought to our notice that the Court on an earlier occasion directed issuance of notice to the learned Attorney General for India who appeared on one occasion. In case of request on behalf of the learned Attorney General, a set of papers in Writ Petition and I.As. may be supplied to him. The Attorney General or one of the Law Officers nominated by him, may appear before this Court on the next date of hearing. 3. Liberty is granted to file brief written submissions by all the parties after furnishing copies of the same to the other counsel, before the next date of hearing. 4. Learned Additional Solicitor General is permitted to file reply affidavit in I .A. No. 24, with in three weeks. Order accordingly.
