ORDER Heard counsel for the parties. 2. This writ application is directed against the order as contained in Annexure-9 dated 2.12.1999 whereby and whereunder the petitioner has been dismissed from service. 3. It is submitted by learned counsel that the petitioner was appointed as Chowkidar in February, 1999 vide order as contained in Annexure-5 and within an interval of nine months he has been dismissed from service without any rhyme or reason. 4. The order impugned is being assailed mainly on the ground that no reason whatsoever has been assigned for dismissal of the petitioner from service. 5. Learned counsel for the state submits that the petitioner was not the real claimant of the post and upon an objection filed by respondent no. 5 the matter was inquired into and a show cause notice was given to the petitioner and thereafter he was dismissed from service. 6. From Annexure 9 it is not discernible as to for what reason the petitioner was dismissed. In the given facts and circumstances of the case, respondent authorities were required to give sufficient reason in the order of dismissal as contained in Annexure 9. The order impugned as contained in Annexure 9 appears to be a non-speaking order and in that view of the matter the same is not sustainable in law. 7. In the result, this application is allowed. Order as contained in Annexure 9 is set aside and the matter is remitted back to respondent no.2 the District Magistrate, Bhojpur at Arrah for consideration of the matter afresh in accordance with law.
