JUDGMENT 1. - This appeal has been preferred against the award passed by the Motor Accident Claims Tribunal, Jaipur city, Jaipur in M.A.C.T. No. 509/93 by which a sum of Rs. 16,0001- has been awarded to the appellant along with 12% interest with which he has dissatisfied and therefore, he has preferred this appeal for enhancement. 2. In order to examine the claim for enhancement, it was essential to go through the analysis of the evidence discussed in the impugned award which has been incorporated while considering case No. 509/93 relating to the appellant-Ghan Shyam. It has been recorded therein that as per the claimant, he has suffered 5% permanent disability as a result of the injury sustained by him on the leg but the Tribunal has not accepted this plea and has held that the claimant/appellant although had suffered 12% injuries, they were simple in nature and he had not even suffered any fracture on his leg. The appellant was treated at the S.M.S.Hospital Jaipur but the disability certificate which was issued in his case by AW-3 Dr. Mathur has stated in his Cross-Examination that he was not the treating Physician or Surgeon of the claimant-appellant and was issuing a certificate in his personal capacity. The Tribunal, therefore, has recorded a finding that considering the simple nature of injury sustained by the appellant a sum of Rs. 16,000/- would meet the ends of justice. 3. Having heard learned counsel for the claimant and the respondent-Insurance Company, I see no ground to enhance this amount of compensation as there appears to be no basis for doing so. The disability certificate also does not indicate that the appellant/injured has suffered any injury causing permanent disability. I therefore, do not find any ground to entertain this appeal. Hence it stands dismissed at the admission stage itself.Appeal Dismissed at Admission Stage. *******
