JUDGMENT 1. 1. The instant petition has been registered on the letter addressed by the Students Union, Dr. Sampurnanand Medical College, Jodhpur to the Hon'ble Chief Justice as a public interest litigation. The petition is purported to have been signed by 56 students. It is pointed out that the University of Rajasthan by letter dated 22nd, April, 2004 declared the examination programme. As per the said letter the Final Examination Part II (Batch 1999) was proposed to be held on 20th August. 2004. According to the petitioners till the date of the 'titter dated 16.8.2004 no examination schedule was notified. It is alleged that a list of eligible candidates has also not been prepared. 2. A counter to the petition has been filed supported by the affidavit of Dr. V.K. Chawla, Associate Professor, Physiology, Dr. S.N. Medical College, Jodhpur. It is averred that the examination programme of Final M.B.B.S. Part II, 1999 was received from the Rajasthan University on 17th August, 2004. It is further averred that out of 56 alleged signatories 55 students have filled in the form and appeared in the examination. Only one candidate namely Heera Ram who claims to be the author of the representation as the Vice President of the Students Union has not filled in the examination form. On 19.8.2004 this Court asked the said Shri Heera Pam, who was present in the Court, if he was prepared to appear in the examination. The author declined the same. In fact such issues cannot be decided on a petition tiled on a letter dated 16.8.2004. Be that as it may, out of 56 candidates Shri Heera Ram who has not filled in the form and not availed the opportunity to appear in examination, must thank himself. No case is made out for invoking the provision under Article 226 of the Constitution of India in the matter. The petition stands dismissed.Writ Petition Dismissed. *******
