( 1 ) THESE cases were heard and reserved for judgment. ( 2 ) A decision by a three-Judge Bench of this Court in Labha Ram and Sons v. State of Punjab has been brought to our notice. The law laid down therein runs counter to the plea raised by the petitioner-appellants. The matters before us relate to the State of Haryana while the decision in Labha Ram and Sons case relates to the State of Punjab. The law and the set of rules applicable to the two States i. e. if there is any difference therein, and if so, what will be its effect on the applicability of Labha Ram and Sons case to the facts of the present case shall have to be gone into. Inasmuch as the decision in Labha Ram and Sons case is by a three-Judge Bench, we deem it proper to place these matters for hearing by a three-Judge Bench. ( 3 ) IN addition, we would like to have the following information brought on record: (I) there were how many commercial sites (category wise) held by the licensed traders/dealers in the old mandis; 00 how many similar sites have been created in the new mandis; (iii) how many sites stand already disposed of and in what manner; (iv) how many of the petitioners have already secured sites in the new mandis. ( 4 ) ORDERED accordingly.
