JUDGMENT 1. - The proceedings under Section 138 of the Negotiable Instruments Act, 1881 have been dropped by the trial Court vide order dated 29.8.1996 relying on the judgment of the Supreme Court in the case of "Common Cause", A Registered Society v. Union of India and ors.1996 Cr.L.R. (SC) 458 . However, in view of the subsequent clarification of Supreme court in the same matter and further the judgment of this Court in the case of Leela Somani v. M/s. Motle Industries Pvt. Ltd. and anr 1997 (Suppl.) RCC 706 . the impugned order dated 29.8.1996 of the trial Court in the present case cannot be sustained.Accordingly, the petition is allowed and the impugned order dated 29.8.1996 is set-aside. The matter is remanded back to the trial Court to proceed further in the matter in accordance with law. The trial however may be expedited. A copy of this order be sent to the trial Court.Petition Allowed. *******
