O R D E R Post on 18-1-2005 in the motion list. On the fact of it, the course of action adopted by the respondents against the Petitioner is high-handed and illegal. In a matter where similar steps were taken, this Court summoned the Mandal Revenue Officer concerned and on appearance he admitted the guilt and restored the entire commodities to the dealer concerned. If the petitioner was guilty of any irregularities, the respondents could have required him to explain and passed appropriate orders. Breaking open the locks forcibly, virtually amounts to a criminal act on behalf of the Respondents. Hence, it is directed that the respondents shall forthwith restore the commodities to the Petitioner and permit him to function as a fair price shop dealer and it shall be open to the Revenue Divisional Officer, Kandukur to pass approriate orders, after giving an opportunity to the Petitioner. --X--
