dh ikyuk esa fd;k x;k ukekUrjdj.k fujLr dj ,dyihB ds fu.kZ; ds iwoZ dh fLFkfr cgky dh tk ldrh gS\ lhihlh dh /kkjk 144 esa tks izko/kku fd;s x;s gSa] os bl izdkj gS%& Application for restitution - (1) Where and in so far as a decree [or an order] is [varied or reversed in any appeal, revision or other proceeding or is set aside or modified in any suit instituted for the purpose, the Court which passed the decree or order] shall on the application of any party entitled to any benefit by way of restitution or otherwise, cause such restitution to be made as will, so far as may be, place the parties in the position which they would have occupied but for such decree [or order] or [such part thereof as has been varid, reversed, set aside or modified] and, for this purpose, the Court may male any orders, including orders for the refund of costs and for the payment of interest, damage, compensation and mesne profits, which are properly [consequential on such variation, reversal, setting aside or modification of the decree or order]. Sec. 144 - Restitution - Doctrine of - Claim arises even when case, remanded for further derermintion after setting aside decree - Restitution can be claimed despite continuation of remand proceedings and irrespective of results of same - 1966 S.C. 948, followed - Restitution can be made from assigenee and transferees, not impleaded as party to restitution - Surplus land, acquired under Ceiling law transferred to allottees has to be given back to appellant - Hardship of allottees could not be a reason for denial of restitution. 12- jktLo e.My dk mDr fofup; ekuuh; loksZPp U;k;ky; ds fofup; 1966 ,llh ist 948 ¼4½] esa izfrikfnr fl)kUrksa ds vk/kkj ij gSA jktLo e.My ds mDr fofup; 1980 vkjvkjMh ist 670 ds iSjk 16] 17] 18 o 21¼5½ esa bldh foLr`r foospuk dh xbZ gS] tks bl izdkj gS%& Para 16 :- The case of the appellant therefore rests on the right of the restitution under section 144 C.P.C. 1966 S.C. 948 lays down that the principle of the doctrine of restitution is that on the reversal of a decree, the law impose an onligation on the party to the suit who receive the benefit of the erroneous decree to make restitution to the other party for what he has lost. Even in case where the decree is set aside and the case is remanded the right of restitution is not touched by the fact of s. subsequent decree upon fresh disposal of the suit. A party is entitled to restitution because on that date the decree in execution of which his properties were disposed had been set aside. The party is entitled to restitution notwithstanging any thing which happens subsequently as a right to claim restitution is based upon the existence ot otherwise of a decree in favour of plaintiff at the time when the application for restitution is made. This ruling therefore supports the view that a claim of restitution arises even when the case is remanded for further determination, after setting aside the decree. Para 17 :- 1974 Allahabad 82 lays down that the right to claim to restitution can be enforced against a party or his transferee or assignee even when he is not a party to the application for restitution. A transferee is equally bound by the order of the restitution inspite of the fact that he is not impleaded as a party. It is clearly found that the word ``parties mentioned in section 144 C.P.C. would cover the transferee or the assigence of the losing party in the litigation. Para 18 :- 1935 Privy Counsel 12 elaborates the duty of the courts when awarding the restitution under section 144 of C.P.C. The court shall place the applicant in the position in which he would have been if the order had not been made. It is laid down that restitution involves payment of mesne profits, interests etc. Para 21:- Regarding the un-reported S.B. judgement dated 20-10-78, the learned counsel for the appellant has pointed out that a writ petition has been filed in the Rajasthan High Court bearing No. 933/78 and the execution and operation of the orders of Board of Revenue have been stayed by the Honble Rajasthan High Court. Irrespective of the stay, we do not find that the judgement discloses any special reasons of denying restitution in the present case. The main ceiling case can be considered pending only in the present sence that the Addl. Collector, Kota in his order dated 8.11.77 has remanded the case for further inquiry to the Authorised Officer after setting aside the order dated 20.6.76. There is no gainsaying in the fact that the order dated 20.6.76 which resumed the land has been set aside. Therefore as provided by 1966 S.C. 948 restitution can be claimed despite the continuation of remand proceedings and irrespective of the results of the same. As discussed at para 17 above, restitution can be made from assignee and transferee who may not have been impleaded as a party to the application of restitution. In the present case the State Government after gaining land through the order dated 20.6.76 has transferred it to the allottees. It is therefore fully according to the principle of the restitution for the land to be given back to the applicant by securing it from the allotees the allotees need not be parties to the application of restitution. We fully agree that this will cause of hardship to the allotees and they may have a claim for compensation. These problems have been created by the State Government when they made the allotments had been stayed pending disposal of appeal such a situation may not have arisen. The existence of such hardship or claims cannot be a reason for the denial of restitution. We do not think that is is necessary for disposal of a restitution application to hear the allotees. If restitution under section 144 of C.P.C. is not barred by any specific provision of law we do not see how the order of Authorised Officer dated 9.1.78 can be found objectionable.
