ORDER : 1. Leave granted. 2. Heard parties. 3. The High Court has in a Second Appeal proceeded to dispose of the Second Appeal without framing any substantial question of law. This is against well settled law. We, therefore, set aside the impugned Judgment and remit the matter back to the High Court. 4. The High Court shall consider whether any substantial question of law arises. If any substantial question of law arises, the High Court will proceed to first frame the questions of law and then proceed to decide those questions. 5. The Appeal stands disposed of accordingly.
