It cannot allow the statement of the Judges to be contradicted by statements at the Bar or by affidavit and other evidence. If the Judges say in their judgment that something was done, said or admitted before them, that has to be the last word on the subject. The principle is well settled that statements of fact as to what transpired at the hearing, recorded in the judgment of the court, are conclusive of the facts so stated and no one can contradict such statements by affidavit or other evidence. If a party thinks that the happenings in court have been wrongly recorded in a judgment. In Bank of Bhihar vs. Mahavir Lal AIR 1964 SC page 377 the court observed : ``Where a statement appears in the judgment of a court that a particular thing happened or did not happen before it, it ought not ordinarily to be permitted to be challenged by a party unless both the parties to the litigation agree that the statement is wrong, or the court itself admits that the statement is erroneous. Section 40 of the Act confers a right of appeal on an aggrieved party against the final order of a Tribunal to the High Court. The section conferring the said power does not provide for a statutory stay of the order of the Tribunal till the disposal of the appeal. Indeed O. XLI, R. 5 of the Code of Civil procedure, which embodies the general principle of law stays that an appeal shall not operate as a stay of proceedings under a decree or order appealed from except so far the appellate Court may order. This principle which applies to stay of proceedings under an order will apply with greater force to a suspension of an order.
