JUDGMENT 1. - This bail application u/s. 438 Cr.P.C. has been filed on behalf of petitioner-Rajendra alias Raju who apprehends his arest in case FIR No. 220/2003 P.S. Shahjahanpur for offences u/ss. 341, 324 & 307 IPC. 2. The allegation against him is that he caught hold of injured Suresh while co-accused-Man Singh voluntarily caused him a stab wound with knife in his stomach with the intention to kill him. 3. Having regard to the submissions made at the bar, the nature of accusation and all other facts and circumstances of the case. I deem it just and proper to enlarge the petitioner on pre-arrest bail. 4. In the result, the bail application is allowed and it is directed that in the event of arrest of petitioner-Rajendra alias Raju son of Shri Sheo Ram Singh in FIR No. 220/2003 registered at P.S. Shahjahanpur, he shall be released on bail by the concerned SHO/Investigating Officer provided he furnishes a personal bond in the sum of Rs. 20,000/- with one surety in the like amount to his satisfaction on the following conditions : (1) that the petitioner shall make himself available for interrogation by a Police Officer as and when required; (2) that the petitioner shall not directly or indirectly made any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or any Police Officer; and (3) that the petitioner shall not leave India without previous permission of the Court. Anticipatory bail application allowed. *******
