( 1 ) THE present Contempt Petition has been filed under Section 12 of the Contempt of Courts Act, 1971. It is, inter-alia, prayed that the opposite party be punished for having committed contempt of this Court by allegedly disobeying the order dated 31st August, 1993 passed by this Court in Civil Misc. Writ Petition No. 2727of 1990. ( 2 ) A perusal of the Order-Sheet of the Contempt Petition shows that the case is being listed before the Court on various dates since May, 2004. However, the learned counsel for the petitioner-applicant has not been appearing before the Court, even when the case has been taken up in the revised list on the said dates. ( 3 ) REFERENCE may be made to the orders dated 21st May, 2004, 12th August, 2004, 27th September, 2004 and 23rd November, 2004, passed on the Order-Sheet. ( 4 ) THE case has been taken up today in the revised list. However, the learned counsel for the petitioner-applicant is not present. Having regard to the nature of controversy involved in the present case and keeping in view the continued absence of the learned counsel for the petitioner-applicant in the present Contempt Petition, it appears that the present Contempt Petition has become infructuous by lapse of time. ( 5 ) IN the circumstances, the Contempt Petition is dismissed as having become infructuous. Show cause notice issued to the opposite party, pursuant to the order dated 27-1-1995 passed on the Contempt Petition, is discharged. .
