Judgment 1. Learned counsel for the parties have no objection to the following order being passed : 2. It is agreed between them that the plaintiff who filed the suit died. The defendant expressed his intention to be transposed as a plaintiff. This prayer was denied. Thus, the present civil revision. 3. This is hardly a matter which should become an issue that the defendant be permitted to be transposed. If the defendant is interested in bringing in an action in himself as a plaintiff that may be the subject matter of another cause and the present suit may be dismissed for non-prosecution and yet it would not stop the defendant in bringing in an action as a fresh suit. 4. There is hardly any occasion to challenge the order by which the trial court has denied permission for transposition of the defendant as a plaintiff. 5. Consigned.
