Bangali Pandey v. Bharosh Raut

2004-03-09

RAVI S.DHAVAN

body2004
Judgment 1. Amendments were denied to the plaintiffs without giving permission to add Ram Ashray Raut as a defendant in whose favour, it is contended, a parcha had been issued by an order of the Anchal Adhikan dated 6 July 1992 in Case No. 3/1992-93. 2. The amendments were opposed by the defendants on the ground that these aspects are becoming the subject matter of amendments beyond the period of limitation. These aspects are not denied by the plaintiffs. In the circumstances, the amendments were rightly denied. 3. If the plaintiffs are of the opinion that there was yet another person who had been given a parcha out of the same plot, that is, Khata no. 96, Khasra no. 2337 of 7 kathas 17 dhurs then that could become the subject matter of another action but it could not become a plea in a suit beyond limitation. 4. Dismissed.
