JUDGMENT 1. - During the course of hearing, the learned counsel read the 1 order-sheets, Annex. 11, and its transpires that vide order dated 4.8.1999, the case was fixed for arguments on the fairness of the D.E. Before reading the order-sheets learned counsel was making a submission that the Tribunal did not give opportunity to the petitioner to lead evidence. 2. Alter reading of this order-sheet. reamed counsel was asked, as to whether the D.E. has been found to be fair, or not, to which, he replied that it was found fair. Thereafter, learned counsel was asked, as to what type of evidence the petitioner was to lead after the D.E. was found by the Labour Court to be fair, to this, learned counsel made contemptuous gestures about the query put by the Court. Then the attention of the learned counsel was invited that the query of the Court is required to be answered, and the contemptuous gestures are not required to be made. Thereupon, the learned counsel walked out saying that he does not want to argue the matter. 3. Since nobody is present on behalf of the petitioner, the writ petition is therefore. dismissed in default.Writ Petition Dismissed. *******
