ORDER 1. Heard counsel for the parties and considered the counter affidavit filed on behalf of the State today. 2. Basically, this writ application was filed for issuane of a writ of mandamus commanding the respondents upon the respondents to issue necessary orders declaring the number of posts to accommodate Junior Engineers by way of promotion to the posts of Assistant Engineers. 3. Today a counter affidavit has been filed on behalf of the State stating therein, inter alia, that such posts have been identified to promote the petitioners from the posts of Junior Engineers to that of Assistant Engineers, as claimed by the petitioners and concurrence of the Bihar Public Service Commission has also been obtained as far back as on 21.6.2003 and thereafter the matter has been sent to the-Personnel and Administrative Reforms for roster clearance etc. 4. Learned counsel appearing on behalf of the State, in that view of the matter, submits that the process of issuance of notification may take some more time. 5. Since the claim of the petitioner is not being denied and the process to give promotion to the Junior Engineers, has started, in my opinion, the respondent authorities should complete the formalities and issue notification within a period of three months from the date of receipt/production of a copy of this order. 6. With the direction/observation aforesaid, this application is disposed of.
