Judgment :- The above writ petition is filed for issuance of a writ of mandamus directing the respondent to release the vehicle i.e., tempo bearing Registration No.TN- 74 - Z - 6586 seized on 20.2.2004 to the petitioner. 2. The learned Special Government Pleader takes notice for the respondent. 3. Taking into consideration of the relief prayed for, the respondent is directed to release the vehicle seized on 20.2.2004 on fulfilling the following conditions:- a) the petitioner shall establish the ownership of the vehicle by producing necessary certificates before the respondent; b) the petitioner shall not alienate the vehicle in any manner; c). The petitioner shall deposit a sum of Rs.5,000/- (Rupees five thousand only), which is agreed to by the petitioner, before the respondent by way of cash; and d) the petitioner shall give an undertaking that he will not use the vehicle for any illegal activities in future and also to produce the vehicle as and when required by the respondent. 4. With these directions, the writ petition is disposed of. No costs.
